Suspend the Chief Justice if Sufficient Evidence Exists – Ansa-Asare Advises Mahama

Kwaku Ansa-Asare, former Director of the Ghana School of Law, has advised President Mahama to suspend Chief Justice Gertrude Torkornoo if there is sufficient reason to do so under the law.

The statement was made during an interview, where Mr. Ansa-Asare said that if a “prima facie” case — which is literally translated as a case with enough basic evidence — is established against the Chief Justice, then the President is mandated by the 1992 Constitution to suspend her while a committee investigates the matter.

Mr. Ansa-Asare referred to Article 146 of the Constitution, which outlines the process for removing a Chief Justice or any top judge from office.

It is important to note that Chief Justice Torkornoo has reportedly submitted her written response to petitions seeking her removal from office. This response was sent to the President and the Council of State before the deadline on April 7, 2025.

Mr. Ansa-Asare further stated that once a committee is established to investigate the petition, the Chief Justice should step aside to preserve the integrity of the investigation.

“If the Chief Justice continues to stay in office while a committee is investigating her, it could raise some level of concerns about fairness and interference,” he emphasized.

“If the petition has no merit, then there is no need to hold this case. But if it has some truth, then suspension may be the right thing to do,” he concluded.
