John Dramani Mahama, the President of Ghana, has given Chief Justice Gertrude Esaaba Sackey Torkornoo 10 days to respond to three petitions seeking her removal from office.
Justice Torkornoo had earlier written to the President requesting copies of the petitions submitted to the Council of State.
In a swift response, Dr. Callistus Mahama, Executive Secretary to the President, issued a letter stating that she must submit her preliminary response within 10 days.
In the letter, the President assured the Chief Justice that due process would be followed and that she would have a fair opportunity to present her case.
It is important for our readers to note that, according to reports, the President had received three petitions from individuals requesting the Chief Justice’s removal. Two petitions were dated February 14, 2025, and the third was dated March 17, 2025.
On the basis of these petitions, the President, on March 24, 2025, wrote to the Chairman of the Council of State, forwarding the petitions for consultation. The President informed the Council, as required under Article 146(6), and sought the Chief Justice’s initial response.
The Chairman of the Council of State agreed to the President’s request.
The President was further advised that, based on the case of Frank Agyei Twum v. Attorney General and Bright Akwetey [2005-2006] SCGLR 732, confidentiality applies to proceedings under Article 146 and must be duly observed.
